Haus of Airis Terms and Conditions

This contract is between Haus of Airis (the "Business") and Buyers of Services (the "Client").
 

Terms:

WHAT WE NEED

1. Within 20 feet of a power outlet.
2. 10x10 feet of space to set up and operate without blocking foot traffic.
3. A minimum ceiling height of 8 feet is needed for our professional canopy setup

SERVICE PERIOD

The service period will be as requested by the client during checkout.

The Haus of Airis agrees to have a photo booth operational for a minimum of 80%
during this period; occasionally, operations may need to be interrupted for maintenance of the photo booth.

If Haus of Airis is unable to supply a working Photo Booth for at least 80%
of the Service Period, the Client shall be refunded a prorated amount based on the amount of service received. If the printer fails to print out photos on-site Haus of Airis will be allowed to give a website to the client where their guests can log in and download the digital files for their own use.

HIRING, DELIVERY & SERVICE

Delivery, setup, and removal of the Photo Booth are free of charge.

The time taken to deliver, set up, and remove the Photo Booth will be outside the rental period.

A trained Photo Booth operator will be with the Photo Booth at all times for quality assurance. Care will be taken by Haus of Airis to ensure delivery of high-quality photo strips, however, should equipment failure or damage caused by personal injury or guests occur, liability is limited to monies paid.

PAYMENTS & FEES

Prices are subject to change please check before booking for current rates. 

By paying any part of the invoice the Client is also agreeing to the Terms & Conditions. A non-refundable deposit of $250 of the total product offering selected at the time of booking. The Deposit or full paid monies in the total cost is necessary to secure the event time and date and is due upon reservation. 

The outstanding amount must be paid by the Client to Haus of Airis at least 7
days before the event.

If booked within 7 days of the event, non-refundable full payment must be received within 48 hours of booking.

A travel surcharge may apply to events outside of the 15-mile radius from (16098 Castroville Blvd, Salinas CA, 93907).

An idle fee may apply for extensive waiting periods.
Certain dates may be subject to an additional surcharge.

Premium dress props (if used) must be in good order at the end of the event, otherwise, charges may apply.

TRAVEL FEE (if applicable)

There is no travel fee for events held within a 15-mile radius of 16098 Castroville Blvd, Salinas CA, 93907. 

Outside of this radius, the Client will be charged .75¢per mile per additional mile traveled.

Example: If the location is 60 miles from 16098 Castroville Blvd, Salinas CA, 93907. then a $33.75 travel charge will be added to the rental. Google Maps will be used to determine travel distance, and the fastest time without traffic.

DATE CHANGES & CANCELLATIONS

Any request for a date change must be in writing at least thirty days in advance of the original event date. Change is subject to Photo Booth availability and receipt of a new service contract. If there is no availability for the alternate date, the non-refundable deposit shall be forfeited and the event canceled. If the event is canceled for any reason, the non-refundable reservation fee is forfeited.

**Please note the deposit is non-refundable. Under no circumstances will your deposit be refunded Haus of Airis cannot be held responsible for unforeseen delays at the venue.**

OPTIONAL EVENT ADD-ONS & RATES

"Additional Booth Time" requested by the client prior to the event in writing or email or at the event by request of the attendant will be charged at the rate of $150 per hour (pro-rated-rounded up to the next half hour).

Additional "Idle Time" will be added at the rate of $25/hour. Any and all add-ons are chosen within this contract or in written or email form by the client will be added to the final payment and paid to Haus of Airis in accordance with the contract payment schedule

PRINT DESIGN APPROVAL

Haus of Airis will email proof of your print design before your event. Please
examine your proof carefully. Once you approve the proof for your event Haus of Airis Photo Booth is not responsible for any errors after approval by the client. 

ACCESS, SPACE & POWER FOR PHOTO BOOTH

The client will arrange for an appropriate space for the photo booth at the event’s venue. (No Gravel or sand Client assures that flat access is available to unload the equipment at the location of the event. If the event is outdoors, the client shall be responsible to provide a shaded area, solid surface) and protection from sun, rain, or snow. The client is responsible for providing power for the photo booth. The photo booth requires a 5 amp, 3 prong outlet from a reliable power source within 20 feet (along a wall) of the setup area.

The available outlet must be solely devoted to the photo booth. Dj equipment, uplight, or any other equipment plugged into the same outlet will prevent the correct power to the photo booth and cause a shortage of the photo booth. 

Any delay in the performance or damage to the photo booth equipment due to improper power is the responsibility of the client. The Client shall
provide the Haus of Airis Photo Booth with safe and appropriate working conditions and a solid floor. This includes a 10’ x 10’ x 10’ area for setup.

VENUE AND LOCATION LIMITATIONS

Haus of Airis Photo Booth may be limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on the provider. Negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; the provider will offer technical recommendations only.

PERMITS:

If applicable, the CLIENT is responsible for acquiring all permits and necessary permission for all locations in which the services will be performed.

PRIVACY

Haus of Airis will not sell your details to any third party and will take reasonable
measures to ensure that your details remain confidential. Haus of Airis may contact you with future special offers.

USE OF IMAGES

When hiring The Haus of Airis Photo Booth, the Client gives permission for images taken at the event to be used on Haus of Airis Photo Booth events' website(s) / social media for advertising purposes.
Haus of Airis will not use images that are deemed unsuitable on their website
or for advertising and will not use any content that may be personally damaging to any person/s.

ONLINE GALLERY

All uploaded photos from the event of the Client on https://www.hausofairis.com/photo-albums may be deleted 14 days after the event.

ATTENDANTS ILLNESS OR INJURY:

Should the Company personnel previously assigned to the event become unexpectedly ill or injured, the Company shall make its best efforts to secure the services of alternative local personnel for the event. If the services of alternative local personnel cannot be secured, then the Company shall promptly reimburse Client any and all Service Fee amounts Client has previously paid to the Company in connection with the applicable Event, and neither party shall have any further obligations or additional liability under this Agreement.

Food & Breaks

Haus of Airis Food / Alcohol Policy: 
Each attendant(s) will be provided a full guest meal for events lasting 4 hours or more. Attendants will not accept any alcoholic beverages, before, during, or after the client's event.

Breaks: 
Throughout the event, Haus of Airis attendant(s) is at liberty to step away from the photo booth for a maximum of 45 minutes once the attendant has verified all services are working at 100% This is to allow for Haus of Airis staff time for a proper meal break. If the attendant leaves the client site, the attendant is now considered on-call and shall report to the station immediately to rectify any errors that may have occurred with the photo booth during the 45-minute meal break.

INAPPROPRIATE BEHAVIOR BY GUESTS

If at any point during the Event the Company personnel, in their sole and absolute discretion, determine that the behavior of the Event guests, staff, attendees, or other person(s) at the Event is inappropriate, threatening, hostile, or offensive, including but not limited to behavior that the
Company personnel determines to make them feel unsafe, harassed, or sexually harassed, the Company personnel may immediately cease to provide any further services and leave the Event. In such an instance, the Client will remain fully liable for any sums due, including but not limited to the Service Fee, as stated in this Agreement, and the Company shall be fully discharged of
any and all further liability to the Client.

FORCE MAJEURE

No Party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to, acts of God (such as hurricanes, earthquakes, flooding), fire, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, terrorist acts, insurrections and/or any other cause beyond the reasonable control of the Party whose performance is affected. Should Clients’ Events be canceled, postponed, or otherwise adversely impacted as a result of a force majeure event, there shall be no refunds for
payments already received by Haus of Airis, but Haus of Airis will use all reasonable efforts to work with Clients to produce the Event at a later date if
necessary, subject to Haus of Airis Photo booth availability.

LIABILITY

The client agrees to assume full responsibility and liability for any and all claims arising out of the use of the photo booth or its booth attendants. Haus of Airis Photo Booth will not be held liable for any injury, loss, or damage directly or consequently arising out of the use or rental of the photo booth. The client will indemnify Haus of Airis Photo Booth, and hold Haus of Airis Photo Booth harmless from all claims, actions, proceedings, costs, damages, and
liability including attorney’s fees, arising out of, in connection with, or resulting from the rental of Haus of Airis Photo Booth.

MISCELLANEOUS TERMS

If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then the provision, or portion thereof, shall be deemed several from the rest of this contract and shall not be valid and enforceable of any remaining provision, or portion thereof.
This is the entire agreement between Haus of Airis and the Client relating to the
subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, the Client agrees to solve any arguments via arbitration. In the event, that Haus of Airis is unable to supply a working photo booth for at least 80% of the service period, the client shall be refunded a prorated amount based on the amount of service received. If the printer fails to print out photos on sight Haus of Airis
will be allowed to give a website to the client where their guest can log onto and download digital files for their end-use.

INDEMNIFICATION

The client agrees to, and understands the following:
a) Client will indemnify the provider against any and all liability related to the client's event during or after the client’s event. The client will indemnify the Provider from the time of service and on into the future, against liability associated with the client.

b) Client will indemnify the provider against any and all liability associated with the use of the picture/video taking within the photo booth of its representatives, employees, or affiliates at the clients' events.
